Bali nine smuggler to fight death sentence

One of the convicted Bali nine drug smugglers, Scott Rush, is to lodge an independent constitutional challenge to his death sentence soon.

A lawyer for two other Australians on death row, Andrew Chan and Myuran Sukumaran, has filed similar challenges in Indonesia's Constitutional Court.

Todung Mulya Lubis says Article 28 of Indonesia's Constitution guarantees the right to life.

He is optimistic the court will take this opportunity to make history.

"Even though there are still death sentences here and there in the Indonesian system, this is going to be history - the Constitutional Court is going to make history," he said.
