First drug houses face end - Alice site targeted
The Territory’s first drug house is now likely to be declared at Alice Springs as police wait to close a Darwin address.
Police sources said last night three notices had been served on one known drug dealing premises at Alice Springs. An application is expected to go before the court within weeks to have it officially declared a drug house under the Government’s new drug laws.
An application by the Drug Squad to have a house in Darwin declared a drug house is still in the hands of prosecutors – two months after it was first submitted. The delay is believed to centre around the interpretation of the new drug house legislation which came into effect on August 1.
Sources said last night that once the legal hurdles had been cleared the Alice Springs site was likely to be the first application to go through.
One of the key reasons to push ahead with the Alice Springs application was to avoid demonstrations by Darwin-based pro-drug protesters.
More than 10 “first notices” have been served on suspected drug premises in Darwin and three “first notices” at Alice Springs.
The drug squad last night again raided known dealers at the Moil Flats at 33 Lee Point Road.
To have a premises officially declared a drug house three notices have to be served within 12 months. Once a successful application has been made to have a premises declared a drug house an iridescent green notice will be pinned to the front door within 17 days.
The notice will read: Warning – these premises are drug premises under the Misuse of Drugs Act. Once a property is declared a drug house, police have the power to:
RAID the premises at any time without a warrant;
SEARCH anyone on the premises and apply for an order authorising an internal search of the body of the person; and
FORCE anyone within 200m of the property to give their name and address.
